A. BACKGROUND As of to date, the Port of Cagayan de Oro remains to rely on telephone, radio and email communications for its maritime monitoring and communications. It is not yet covered by any marine traffic AIS network and navigation equipment. Recognizing the need to modernize and upgrade the ports capabilities to monitor vessel traffic movement to improve operational and fiscal efficiency and for other related purposes including disaster preparedness/response, the Philippine Ports Authority has approved the procurement and installation of an Automatic Identification System in at least five (5) ports, including the Port of Cagayan de Oro. This project has been enrolled as one of PPAs commitment to the Governance Commission for GOCCs (GCG) for CY 2016. B. OBJECTIVE The Port Management Office of Misamis Oriental/Cagayan de Oro in its effort to continually improve its port services to its customers, stakeholders and the general public in consonance with the ISO and PSHEMS standards, and in support of PPAs commitment to GCG, find the necessity to procure and install an Automatic Identification System at the Ports of Cagayan de Oro, Benoni, Guinsiliban, Balingoan and in Sulawan Point in Alubijid, Misamis Oriental in order to enhance vessel traffic movement monitoring in aid of efficient port and harbor management. C. APPROVED BUDGET OF THE CONTRACT The Approved Budget for the Contract (ABC) is SIX HUNDRED THOUSAND PESOS (Php 600,000.00) in Philippine Currency inclusive of 12% VAT. Bids proposed submitted higher than the ABC shall automatically be rejected. F. SCOPE OF WORK Installation of AIS units shall cover the supply, delivery, installation, testing and commissioning of five (5) AIS receivers and its accessories/peripherals at the identified sites. Labor and materials shall include the following; labor (transportation, field allowance, board/lodging and other incidental expenses of technicians); materials (carpentry, welding job and other incidental materials) Supply, delivery, installation, testing and commissioning of AIS viewer software; On-site end-user training including basic troubleshooting, with a duration not less than five (5) working days. Warranty: From the date of delivery of the products, the prospective bidder shall warrant that the products are free from defects in materials and workmanship and shall undertake repair or replacement of any part or portion of the equipment without cost to the government. Warranty period shall not be less than eighteen (18) months. G. TOOLS AND EQUIPMENT REQUIREMENT The prospective bidder shall commit to provide the minimum tools and/or equipment to be utilized during project implementation. Provided, the subject tools and/or equipment are wholly owned, or under lease agreement of which the period of the said contract must not be less than duration of the project. The prospective bidder should exclusively dedicate the aforementioned tools/equipment and personnel/manpower within the entire duration of the contract, or until completion of the project as evidence by the Certificate of Acceptance duly signed by the authorized representative/signatory of PPA-PMO-MOC, whichever comes first. H. QUALIFICATION OF PROSPECTIVE BIDDERS In accordance with Sec. 23.5.1 of the Revised IRR of RA 9184, and the ISO 9001:2008 and PSHEMS Standards currently implemented in this Port, the prospective bidder must possess the following minimum qualifications to be eligible to participate in this public bidding, to wit: (a)Duly licensed Filipino citizens/sole proprietorships; (b)Partnerships duly organized under the laws of the Philippines, sixty percent (60%) of the interest belongs to citizens of the Philippines; (c)Corporations duly organized under the laws of the Philippines, sixty percent (60%) of the outstanding capital stock belongs to citizens of the Philippines; (d)Cooperatives duly organized under the laws of the Philippines, sixty percent (60%) of the interest belongs to citizens of the Philippines; and (e)Citizens or organizations of a country the laws or regulations of which grant similar rights or privileges to Filipino citizens, pursuant to RA 5183 and subject to Commonwealth Act 138. I. TERMS AND CONDITIONS 1. Prospective bidders must undertake the entire scope of work cited above within 30 calendar days upon receipt of the Notice to Proceed. There shall be only one (1) bid for each participating bidder. No bidder is allowed to submit more than one bid. Bidders maybe allowed to withdraw his tender documents before the opening of bids, and the same shall be returned to the bidders unopened. However, no bidder shall be allowed to withdraw his/her offer once and/or after the opening of bids has been conducted or concluded; 10.The bid security shall be returned to the non-winning bidders immediately after the winning bidder has been duly determined and the contract has been awarded, and upon the submission of a letter request for the return of the bid security; 11.The award shall be given to the lowest/single calculated and responsive bid as determined and evaluated by the BAC-PG, and whose bid price is not higher than the ABC; 12. Should there be two or more bidders who submitted the same bid price, BAC-PG shall break the tie in accordance with mechanics provided for under the Government Procurement Policy Board Circular No. 06-2005 dated 05 August 2005; 13. The winning bidder shall not assign or sub-contract or transfer its rights and interest under this contract to any third person, nor shall the same be honored by PPA. 14. All incidental expenses shall be borne solely by the winning bidder including the weighing fees, fees and taxes and other charges; 15. There is no employee/employer relationship between employees of the winning bidder and PPA. Hence, the winning bidder shall solely assume responsibility for the payment of salaries, monetary benefits and such other payment for injuries which may be suffered by its employees while implementing the contract. 16. The winning bidder shall assume full responsibility, be liable and agrees to indemnify PPA, or any party/ies for any loss, damage, destruction and/or injury which are attributable in whole or in part to the negligence, fault, laxities, unlawful act or misconduct of the former and/or through its authorized representative or personnel arising from the performance of the project, or resulting from theft, pilferage, robbery, arson and accidents/incidents. The damages or injuries shall be reported in writing to Թand/or other parties immediately or within two (2) days from the date of its discovery to enable Թto investigate the matter. However, the winning bidder is not precluded from pursuing any legal action against the person responsible. 17. The winning bidder shall observe and comply with all ԹRules and Regulations, including Safety and Environmental Standards set by Թand the Department of Labor and Employment (DOLE) Occupational Safety and Health (OSH) Center while dismantling the unserviceable LLC inside the port.
